INTRODUCTION

Welcome to the Beecrowd website or mobile application or platform (“Site”). Beecrowd Marketplace Ltda (“Beecrowd”, “we”, “us”, and/or “our”) operates this Site, to provide our users (“you” and “your”) with information about Beecrowd and its Site (Network).

Beecrowd is used by students and independent professionals, “Beecrowders” “Talents” and/or “Users”) who wish to offer their software development, other systems development services and project management services(“Services”) and by clients (“Clients”) who need the Beecrowd services, from Talents and/or from Beecrowd. Beecrowd is also used by educational institutions and their professors (“Professors”) to run their classes and promote and support computer systems and related classes. The Personal Data we receive from Talents, Clients and Professors and how we handle it differs, so we explain our data practices for Talents, Clients and Professors in the distinct sections below. Navigate to the section that applies to you.

This privacy policy has been developed to better serve those who are concerned about how their 'Personally Identifiable Information' (PII) is being used online. PII is information that can be used alone or with other information to identify, contact or locate a single person, or to identify an individual in context. Please read our privacy policy carefully to gain a clear understanding of how we collect, use, protect or handle your personally identifiable information according to our Site.


BEECROWDERS / TALENTS / USERS

PERSONAL INFORMATION

WHAT PERSONAL INFORMATION DOES BEECROWD COLLECT FROM PEOPLE WHO VISIT OUR SITE?
When you apply as a beecrowder on the Site, you are asking to be admitted to our Network. In order to admit you to the Network and match your qualifications with our client’s needs, we need to perform a screening process, which evaluates your language skills, personality, domain-specific knowledge, competence and professionalism. We may also need to screen potential beecrowders for specific technical skills, or recruiting as required by our Clients. In this context, you will be asked to provide information about yourself, which may include the information below (in some cases not all information will be required):

• Your name
• Contact information (email and phone number)
• Personal ID information
• Date of birth
• Gender information
• Address
• Location
• Photo
• Social network information
• Work experience
• Education and languages
• System development skills and computing marathons participation
• Openness for providing services
• Billing information

In case you decide to deliver your services at beecrowd disposal, our provider of background check services may collect additional data about you (including information about criminal convictions or offenses) if and when we undertake vetting/background checks. If applicable to you, your consent to the collection of such additional data will be solicited at such time, pursuant to applicable laws in each location.

When you participate in the community of Beecrowd’s experts on our Site, we will collect the information that you elect to share in that context. We will use certain of your Personal Data to enable you to create a profile to be displayed within the Services; this profile is searchable and may be viewed by Clients seeking beecrowders to delivery services. Our mobile application is also accessible by members of our Talent network. The mobile application may collect information, including, but not limited to location data, in an effort to tailor the user experience.

Once you are admitted to the Network and you are matched with a Client, we will receive from our Clients information regarding the performance of your services to that Client, as necessary for maintaining standards of integrity and excellence in our Network.
In addition, Beecrowd may record video and/or phone calls for quality assurance and training purposes.

This data is used to authenticate you correctly and also to control the platform.
When you submit a solution to a problem in our repository or in competitions hosted on our Site, the source code is stored on our servers and it´s become to be considered Beecrowd property. 
We also collect data you provide to us using any form. This forms also may contain data or information that you agree to share with us.

WHEN DOES BEECROWD COLLECT INFORMATION?
We collect information when you interact with Beecrowd by registering on our Site, subscribing to our newsletter, responding to our surveys, filling out our forms, sending us feedback, opening a support ticket, or entering information on our Site.

You can update your data at any time on your profile page.

You can request to delete your account at any time.

HOW DO WE USE YOUR INFORMATION?
A. To Provide services and respond to requests
Beecrowd uses the Personal Data you provide in a manner that is consistent with this Privacy Policy. If you provide Personal Data for a certain reason, we will use the Personal Data in connection with the reason for which it the data was provided.
In particular, we use data that you provide to us (described above) in order to process your request to become a beecrowder, to participate in a recruiting process and administer our contract with you once you become a member of the Network. For individuals in the European Union EU, our use of Personal Data that you provide to us is necessary in order to implement your request to become a beecrowder prior to entering into a contract with us and, once you are admitted to our Network, to perform our contract with you. In any circumstance you do authorize us to keep this data.

B. As Necessary for certain legitimate interests
As herein described and authorized by you, we use your Personal Data for the legitimate interests described below:

• To send administrative information to you, for example, information regarding the Site and changes to our terms, conditions, and policies.
• To conduct analytics on how the Site and the Services are being used by you for our internal purposes, namely for providing, maintaining, benchmarking and improving our offerings, and identifying usage trends.
• We use data relating to your use of and interaction with the Site and the Services, including use of product features by you and information that we obtain through cookies and other technologies, to better understand your needs and interests to personalize your experience with our Services.
• To market our Services and showcase beecrowders (in particular, we can feature certain profiles of beecrowders to drive traffic from potential Clients).
• To prevent fraud or criminal activity, misuses of our Site or Services, and ensure the security of our IT systems, architecture, and networks.
• To (a) comply with legal obligations and legal process, (b) respond to requests from public and government authorities including public and government authorities outside your country of residence; (c) enforce our terms and conditions; (d) protect our operations; (e) protect our rights, privacy, safety, or property, and/or that of you or others; and (f) allow us to pursue available remedies or limit the damages that we may sustain.
• If you ask us to delete your data and we are required to fulfill your request, however, in accordance with legal provisions, we may keep basic data to identify you and prevent further unwanted processing.

We may use the information we collect from you when you register, subscribe to our newsletter, respond to a marketing survey or communication, browse the Site, or use other features of the Site in the following ways:

• To personalize your experience and allow us to deliver the type of content you're most interested in;
• To improve our website in order to better serve you;
• To allow us to better serve you when responding to your service requests;
• To administer a contest, promotion, research or other feature of the Site;
• To ask for opinions and comments on services or products;

• For professional purposes and connect you with Clients and/or Projects.


PROFESSORS

WHAT IS THE INFORMATION THAT BEECROWD COLLECTS?

A. Information that you provide to us
We collect Personal Data from our Professors when we receive a request for using our Site. This includes names and contact information of prospective Professor and its related Educational Institution’s representatives, and any information relating to the Professor’s needs. We also collect Personal Data that is entered on our Site or sent to us electronically, for example when you complete a web form to give Personal Data to us directly (such as on our “Contact Us” page), when you voluntarily provide such information such as when you register for access to the platform (for example, your name and mailing address), contact us with inquiries or respond to one of our surveys. Wherever Beecrowd collects Personal Data we make an effort to provide a link to this Privacy Policy.
Information we require from Professors may include the ones described below (as not all will be required):

• Taxpayer number

Professor user information
• Username
• Name
• Role
• Contact information (email and phone number)

In addition, Beecrowd may record video and/or phone calls for quality assurance and training purposes (general information provided by general institution).

B. Information obtained from third parties
We may supplement the information that we collected from you (such as your email address) with additional information about you and your company obtained from publicly available and third-party databases or services that provide information about academic people and educational institutions (including an individual’s name, title, contact information, and educational institution information).

C. Automatically collected data
When you interact with Beecrowd through the Site or Services, we automatically collect certain information. 

HOW DO WE USE YOUR INFORMATION?
A. To provide the Services and respond to requests
Beecrowd uses the Personal Data you provide in a manner that is consistent with this Privacy Policy. If you provide Personal Data for a certain reason, we may use the Personal Data in connection with the reason for which it was provided. For instance, if you contact us by email, we will use the Personal Data you provide to answer your question or resolve your problem. Also, if you provide Personal Data to obtain access to the Site and the Services, we will use your Personal Data to provide you with access to such Services, maintain your account, contact you regarding your use of the Site and/or the Services or to notify you of important changes to the Site and/or the Services, and to monitor your use of such services. For individuals in the EU, such use is necessary to respond to or implement your request and for the performance of the contract between the Professor and Beecrowd.

B. For Marketing Purposes
We may use your contact details to tell you about services we believe will be of interest to you, upcoming events or other promotions. If we do so, each marketing communication we send you will contain instructions permitting you to “opt out” of receiving future marketing communications. Note, however, that as a user of our services you cannot opt out of some administrative communications that are reasonably necessary to the services, such as billing or service notifications. In addition, if at any time you wish not to receive any future marketing communications or you wish to have your name deleted from our mailing lists, please contact us as indicated below.

Where required by applicable law (for example, if you are an individual in the EU), we will only send you marketing information by email if you consent to us doing so at the time you provide us with your Personal Data. When you provide us with your consent to be contacted for marketing purposes, you have the right to withdraw your consent at any time by following the instructions to “opt-out” of receiving marketing communication in each marketing email we send you or by contacting us as indicated below.

CLIENTS

WHAT IS THE INFORMATION THAT BEECROWD COLLECTS?

A. Information that you provide to us
We collect Personal Data from our prospective Clients when we receive a request for hiring our beecrowders. This includes names and contact information of prospective Client’s representatives, and any information relating to the Client’s needs. We also collect Personal Data that is entered on our Site or sent to us electronically, for example when you complete a web form to give Personal Data to us directly (such as on our “Contact Us” page), when you voluntarily provide such information such as when you register for access to the platform (for example, your name and mailing address), contact us with inquiries or respond to one of our surveys. Wherever Beecrowd collects Personal Data we make an effort to provide a link to this Privacy Policy.

DATA COLLECTED AUTOMATICALLY

DOES BEECROWD COLLECT DATA AUTOMATICALLY?
Yes. We automatically collect usage information when you visit our Site or use our Services. We may send one or more cookies to your computer or device that uniquely identifies your browser and allows us to help improve your browsing and improve your experience. Furthermore, we have partnerships, such as with Microsoft Clarity, to gather information on how you use and interact with our website, through behavioral metrics, heatmaps, and session recordings, always with the goal of improving our services, fraud prevention, security, and advertising. Data is collected through cookies and other technologies. By using our website, you agree that we may collect and use such data. You can choose to have your computer notify you whenever a cookie is being sent, or you can choose to disable all cookies. You can do this through your browser settings. Because browsers don't follow a pattern about your settings, check your browser's help menu to learn the right way to modify your cookies. If you disable cookies, you will disable some of the features of the site.

DOES BEECROWD USES TRACKING SERVICES, SUCH AS GOOGLE ANALYTICS?
We also collect analytics data and use third-party analytics tools to help us assess traffic and service usage trends. These tools collect information submitted by your browser or mobile device, including pages visited, the use of third-party applications, and other information that assists us in analyzing and improving the services.

DOES BEECROWD KEEP USER INTERACTION RECORDS?
Yes.  Beecrowd collects information, in log files, from your browser or mobile device whenever you access or use our services. These may include data such as your web request, IP address, browser type, information about your mobile device, reference/output pages and URLs, the number of clicks and how you interact with links in our service, domain names and landing pages, pages viewed, and other such information.

DOES BEECROWD TRACK EMAILS?
Yes. We use transparent gifs in HTML-based emails sent to our users to track which emails are opened and which links are clicked. This information allows us to obtain more accurate reports and thus make improvements to the services.


DATA PROTECTION

HOW DO WE PROTECT YOUR DATA?
Our site is regularly checked for known security flaws and vulnerabilities to make your visit to our site as secure as possible. We also regularly check for malware.
Your personal information is contained in secure networks and is only accessible by a limited number of people who have special rights of access to those systems and are required to keep them confidential. In addition, all sensitive information provided is encrypted through Secure Socket Layer (SSL) technology.
We implement a variety of security measures when a user types, sends or accesses your information to maintain the security of your personal information. In addition to specific training for the team responsible for personal data management

DATA STORAGE

WHERE DOES BEECROWD STORE YOUR DATA?
Our services are hosted in the Digital Ocean cloud. By default, Beecrowd hosts are in the regions of New York (USA). The data we collect is stored on servers located in the United States.
As Beecrowd is headquartered in Brazil, a backup copy of all the data we collect on our Site and the source codes you sent are also stored in our host Digital Ocean.

HOW LONG DOES BEECROWD MAINTAIN DATA?
Beecrowd keeps all data collected until we mark users as inactive or the user deletes their own account. Users can request to delete their own accounts. However, not all information is deleted from our services and backups. A complete list of what is and what is not removed is available on the “Delete Account" page and is also described in our Terms of Service.

Beecrowd retains all collected data for the necessary period to fulfill the purposes described in this policy, including service provision and legal obligations. Users can request the deletion of their own accounts from Beecrowd. However, not all information is deleted from our services and backups. Only information such as user ID, username, etc., sufficient to identify and analyze activities performed by users during the active period, is retained.
Even upon data deletion requests, Beecrowd will retain certain data for the purposes outlined in this Policy. The retention period is determined by the type of data, its purpose, as well as legal and regulatory requirements, security, or fraud prevention reasons. In some circumstances, we may anonymize your Personal Data so that it can no longer be associated with you, in which case it is no longer considered Personal Data.

Our disclosure of your Personal Data and other information
Beecrowd is not in the business of selling your information. We consider this information to be a vital part of our relationship with you. There are, however, certain circumstances in which we may share your Personal Data with certain third parties, as set forth below:

A. Business Transfers
As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, Personal Data may be part of the transferred assets.

B. Agents, Consultants and other Service Providers
Beecrowd, like many businesses, sometimes hires other companies to perform certain business-related functions. These parties include website analytics companies, providers of digital advertising services, our hosting and cloud computing service providers, providers of CRM, marketing and sales software solutions, providers of billing and processing payments functions, providers of background check services, fraud detection and prevention software, and interview and recruitment providers. By joining our network when we employ another company to perform a function of this nature, we only provide them with the information that they need to perform their specific function. Pursuant to our instructions, these parties may access, process, or store Personal Data while performing their duties to us and solely to perform the services we have hired them to provide.

DOES BEECROWD SHARE MY DATA IN AN API?
Beecrowd may transfer some of the information collected through our API to pre-approved applications only if you have confirmed and authorized the third-party application to have access to that information. The information is shared by application and is detailed on the authorization screen. You can revoke this share at any time. However, we are not responsible for the information stored by the third party. Therefore, you must directly request the application to which you previously granted access to delete your data.


EU INDIVIDUALS

Scope
This section applies solely to individuals in the EU (for these purposes, reference to the EU also includes the European Economic Area countries of Iceland, Liechtenstein and Norway and, where applicable, Switzerland). Our Privacy Policy describes why and how Beecrowd collects, uses and stores your Personal Data, the lawful basis on which your Personal Data is processed, and what your rights and our obligations are in relation to such processing (please see “Your Rights” section below).

A. Data Controller
Beecrowd is the data controller for processing your Personal Data. The data controller is responsible for deciding how Personal Data about you is used. Please see the “Contacting Beecrowd” section below to find out how to contact us, which also provides the contact details of our representative in the EU for purposes of the General Data Protection Regulation.

B. Your Rights
Subject to applicable EU law, you have the following rights in relation to your Personal Data:

• Right of access. If you ask us, we will confirm whether we are processing your Personal Data and, if so, provide you with a copy of that Personal Data along with certain other details. If you require additional copies, we may need to charge a reasonable fee.
• Right to rectification. If your Personal Data is inaccurate or incomplete, you are entitled to ask that we correct or complete it. If we shared your Personal Data with others, we would tell them about the correction where possible. If you ask us, and where possible and lawful to do so, we will also tell you with whom we shared your Personal Data so you can contact them directly.
• Right to erasure. You may ask us to delete or remove your Personal Data. If we shared your data with others, we would tell them about the erasure where possible. If you ask us, and where possible and lawful to do so, we will also tell you with whom we shared your Personal Data with so you can contact them directly.
• Right to restrict processing. You may ask us to restrict or ‘block’ the processing of your Personal Data in certain circumstances, such as where you contest the accuracy of the data or object to us processing it. We will tell you before we lift any restriction on processing. If we shared your Personal Data with others, we would tell them about the restriction where possible. If you ask us, and where possible and lawful to do so, we will also tell you with whom we shared your Personal Data so you can contact them directly.
• Right to data portability. You have the right to obtain your Personal Data from us that you consented to give us or that was provided to us as necessary in connection with our contract with you. We will give you your Personal Data in a structured, commonly used and machine-readable format. You may reuse it elsewhere.
• Right to object. You may ask us at any time to stop processing your Personal Data, and we will do so: (1) If we are relying on a legitimate interest to process your Personal Data – unless we demonstrate compelling legitimate grounds for the processing or (2) If we are processing your Personal Data for direct marketing.
• Rights in relation to automated decision-making and profiling. You have the right to be free from decisions based solely on automated processing of your Personal Data, including profiling, which produce a significant legal effect on you, unless such profiling is necessary for entering into, or the performance of, a contract between you and us, or with your explicit consent. We are not currently processing your Personal Data for such type of automated decision-making, including profiling, but if we elect to do so in the future, we will provide you with notice and choice, in accordance with EU data protection law.
• Right to withdraw consent. If we rely on your consent to process your Personal Data, you have the right to withdraw that consent at any time, but this will not affect any processing of your data that has already taken place.
• Right to lodge a complaint with the data protection authority. If you have a concern about our privacy practices, including the way we handled your Personal Data, you can report it to the data protection authority that is authorized to hear those concerns.

C. Legitimate Interest
“Legitimate interests” means our interests in conducting and managing our organization and delivering the best Services to you. This Privacy Policy describes when we process your Personal Data for our legitimate interests, what these interests are and your rights. We will not use your Personal Data for activities where the impact on you overrides our interests, unless we have your consent, or those activities are otherwise required or permitted by law. You have the right to object to processing that is based on our legitimate interests. For more information on your rights, please see “Your Rights” section above.

D. Data Transfers
Beecrowd is headquartered in Brazil. When you apply as a beecrowder, Professor or use our services as a Client, or otherwise use our Site, your Personal Data will be transmitted to servers in Brazil and United States as necessary to provide you with the services that you requested, administer our contract with you or to respond to your requests as described in this Privacy Policy, and the data may be transmitted to our service providers supporting our business operations (described above). The United States may have data protection laws less stringent than or otherwise different from the laws in effect in the country in which you are located. Where we transfer your Personal Data out of the European Economic Area (EEA) we will take steps to ensure that your Personal Data receives an adequate level of protection where it is processed, and your rights continue to be protected.

E. Data Retention
Our policy is to keep your Personal Data only for as long as is reasonably necessary to fulfil the purposes for which it was collected and processed, including for the purposes of satisfying any legal, regulatory, accounting or reporting requirements. If you have elected to receive marketing communications from us, we retain information about your marketing preferences until you opt out of receiving these communications and in accordance with our policies.
To determine the appropriate retention period for your Personal Data, we will consider the amount, nature, and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure of your Personal Data, the purposes for which we use your Personal Data and whether we can achieve those purposes through other means, and the applicable legal requirements. In some circumstances we may anonymize your Personal Data so that it can no longer be associated with you, in which case it is no longer Personal Data.

CONFIDENTIALITY
